WESTMINSTER “THERE’S NO MONEY FOR CARE IN SEFTON” MEETING CONTRAVENES “NO MONEY IS NOT AN EXCUSE” HIGH COURT RULING.

Sefton Care Association (SCA) has been told “there is no money” to pay for the shortfall and backdating of care fees frozen by Sefton Borough Council – in direct contravention of a High Court ruling that says “no money is not an excuse”.

Members of SCA met with Care Minister Paul Burstow, John Pugh MP, Sefton Borough Council Chief Executive Margaret Carney and other officials in Westminster, but before SCA could put its case, the “there’s no money” line was delivered.

“As soon as that was said we realised that not only was our meeting a waste of time, but also that the situation had not been properly researched,” said Dan Lingard of Sefton Care Association.

“As the meeting was conducted under Chatham House Rules, we can’t say who said there was no money – but it was said nevertheless.

“Sefton Council has already defied a High Court ruling and told care home owners and the borough’s vulnerable that it will be freezing care fees for both 2011/12 and 2012/13, a dispute which led to SCA committee members being invited to Westminster to discuss the issue.

“But it’s clear there was no intention of arriving at any sort of a conclusion in that meeting which would be of any benefit to people needing care, or care home owners and operators – especially when we were told ‘there’s no money’.

“But what people in the meeting seemed to have lost sight of is that the High Court ruling in November 2011 said that lack of resources is no excuse for not fulfilling care obligations.”

In paragraph 90 of the ruling, His Honour Judge Raynor QC, sitting as a judge of the High Court, quoted an earlier precedent and ruling: “In paragraph 46(2) of his judgment in the Forest Care Home case, Hickinbottom J stated: ‘In deciding whether a person is in need of care and accommodation, an authority is entitled to have regard to its own limited financial resources. However, having set that threshold and found that a particular person surpasses it, an authority is under an obligation to provide care and accommodation in fulfilment of its section 21 obligations (under the National Assistance 1948), which is a specific duty on the authority owed to an individual, not a target duty: lack of resources is no excuse for non-fulfilment of that obligation…’

“The Claimants (Sefton Care Association) submit that the evidence in this case shows that the decision to freeze fees was taken for budgetary reasons alone or at least to an improper extent, without there being any attempt to balance other factors against the need for financial savings.”

Dan Lingard said: “In other words, no money is not an excuse – care obligations must be fulfilled, and they are not being fulfilled by a freeze in care fees, which, given inflation and other factors, means that not only have care fees been frozen – they’ve actually fallen.”

Judge Raynor ruled that Sefton Council should not have frozen 2011/2012 payment levels to elderly people in care in the borough, and that it did not pay due regard to the actual cost of care in making its unilateral decision. He directed Sefton Council to enter into consultation with local care homes, and to reassess care payments for the 2011/2012 financial year – and establish the actual cost of care by which care fee rates could be set.

But Sefton Council not only ignored the February 9, 2012 deadline to respond, it has also said it will freeze care fees retrospectively, and for the 2012/13 financial year as well – meaning that care fees have been static despite the Retail Prices Index rising nearly 12% in the three years since care fees were last increased.

It’s official – Britain’s most dangerous animals are boxer dog puppies.

That’s the finding of www.gadget-cover.com, the UK’s longest-established mobile phone and electronic gadget insurance provider, which says that the combined teeth and slobber content of a boxer chewing on a mobile phone are fatal – to the phone.

“Puppies, generally, are the animals most cited when claims are made for pet-inflicted damage to mobile phones, iPods, satnavs and other electronic gadgets – but breeds such as boxers, which slobber more than most, result in more moisture damage, which is generally fatal for a phone,” said Carmi Korine of Gadget-Cover.

Puppies chewing on phones are the most common claim, followed by cats chasing them around table tops before knocking them on to hard floors. Wagging dog tails also do their fair share of damage by launching gadgets across rooms from low surfaces, but some claims are difficult to prove.

“We’ve had claims for people who say their snake has swallowed a phone, while others have claimed their parrots have cracked phone screens or peeled off covers, and we have had a claim that a pet monkey stole a phone and in playing with it ended up dialling a number in South America which stayed connected until the battery ran out, and ran up a bill of hundreds of pounds.

“We were speculating that he was phoning home.”

Of animal-related claims made in the first four months of 2012, these were the most frequent:

  1. Puppies chewing phones or gadgets, 29%.
  2. Adult dogs fetching phones for owners, 22%.
  3. Dogs knocking phones onto hard surfaces or into liquid, 19%
  4. Cats knocking phones onto hard surfaces, 13%.
  5. Incidents involving horses, 9%.
  6. Incidents involving fish tanks, 6%.
  7. Other, 2%.

SEFTON COUNCIL IGNORES HIGH COURT RULING – AND FREEZES CARE FEES FOR A THIRD YEAR.

Sefton Council has defied a High Court ruling and told care home owners and the borough’s vulnerable that it will be freezing care fees for both 2011/12 and 2012/13.

Now Sefton Care Association says that as many as 50% of care homes in the borough may be forced to close, generating massive worry and uncertainty for the families of the area’s frail and vulnerable.

Senior council officers dropped the bombshell to care home owners despite a judge telling the local authority in November 2011 that it must make a decision on reassessment of care fees paid to the most vulnerable people by February 9, 2012.

In a Judicial Review in the High Court in Manchester, His Honour Judge Raynor QC ruled that Sefton Council should not have frozen 2011/2012 payment levels to elderly people in care in the borough, and that it did not pay due regard to the actual cost of care in making its unilateral decision. He directed Sefton Council to enter into consultation with local care homes, and to reassess care payments for the 2011/2012 financial year – and establish the actual cost of care by which care fee rates could be set.

But Sefton council says it will freeze care fees retrospectively, and for the 2012/13 financial year as well – meaning that care fees have been static despite the Retail Prices Index rising nearly 12% in the three years since care fees were last increased.

Sefton Care Association, which represents a large proportion of care homes in the borough, says the implications are massive – not just locally, but potentially nationally as a care-fee-freeze precedent has been effectively set, with local authorities likely to stump up the cost of more Judicial Reviews rather than find the cash to increase care fees. Legal bills for a Judicial Review are a fraction of the shortfall in care fees.

Council officers have also told care home owners that an independent report into the cost of care in Sefton, commissioned by Sefton Care Association and carried out by highly-respected research organisation Laing & Buisson, was “deficient” and that council officials “questioned the significance and reliability of the report”.

But Peter Moore of Sefton Council also then told care home owners that “the report provides more data than our own spread sheet did”.

However, Mark Gilbert of Sefton Care Association, said: “Laing & Buisson (L&B) is the foremost research organisation in the sector, recognised by all levels of government – up to and including ministerial level – as being a provider of accurate, independent and unbiased research.

“The key issues are not just the cost of care, but also homes gaining a reasonable return on capital investment so enabling essential maintenance and upgrading of property and equipment essential for the wellbeing of elderly residents.

“There’s a big gap between the cost of providing care and the level of funds Sefton Council currently allocates: families and those in care are struggling to afford the shortfall between Sefton’s current funding provision level, and the cost of care – care homes are doing everything in their power to bring costs down.

“L&B provided information for four categories of care home client support. Typically, nursing care for a frail older person – many of whom require 24/7 support – has, according to L&B, an actual weekly cost of £626, or £699 if we include a 13% return to cover the cost of maintenance and improvement of the care home. But Sefton Council’s currently frozen weekly care fee rate is £510. It is down to the individual client or their family to make up the difference; care home owners have reached a point where there is simply nothing else to cut.”

NEW ENERGY EFFICIENCY RULES: A FIFTH OF PROPERTY IN LINE TO BE EXCLUDED FROM RENTAL AND LEASE MARKET.

A fifth of commercial and residential property may be excluded from the rental and lease market as soon as 2015 unless owners move to comply with energy efficiency rules.

Legislation is already in place which states buildings with a rating of F or G on their Energy Performance Certificate (EPC) cannot be let out after 2018 without works having been carried out to raise the rating level.

But property and construction consultancy McBains Cooper says it has reason to believe the measure may actually be introduced as early as 2015 as part of the UK’s commitment to reduce carbon emissions – something which ties in with the government’s track record of bringing forward some elements of new legislation.

“It might be considered an asset, but it may actually be a liability – and sooner than expected; in summary, if a commercial or residential property doesn’t comply, and its owner for whatever reason wants to switch it to being let out after the anticipated deadline, then he can’t. The owner can, however, renew existing leases, but that owner is potentially exposed should tenants decide to move out of an F- or G-rated building after the deadline date,” said Anthony Coumidis of McBains Cooper.

“We estimate that around one in five buildings fall into the F/G EPC category, including many listed or historical properties. Property owners therefore have only around 1,000 days to raise the efficiency ratings of F/G level buildings, or face them having to stand empty. In some cases, planning permission may be required, which, bearing in mind upgrade designs may need to be drawn up, can mean months of delays before work can actually start.”

In a bid to partly reduce the potential cost impact of the new EPC rules, the government’s “Green Deal” plan comes into operation in October 2012 - the basic concept being that residential and commercial property owners will be encouraged to upgrade the thermal values of the building fabric and to introduce higher efficiency, or renewable-based, HVAC (heating, ventilation, air-conditioning) technology.

Under the Green Deal, the capital cost of the approved works can be covered in the form of a loan which will be repaid over a set time period as an additional sum on the property’s energy bills.  The Green Deal finance is attached to the property rather than the occupant, and if a building is sold or let, the liability for repayment of outstanding Green Deal finance will fall upon the new incoming owner or tenant.

“But for some commercial properties in particular, the most appropriate and cost-effective means of upgrading efficiency ratings may not fall within the Green Deal criteria. What’s more, some owners and tenants may be uncomfortable with what is essentially a loan secured on their property - and may wish to fund improvement work direct,” said Anthony Coumidis.

Squabbling couples, prankster colleagues, children and stroppy bar staff are responsible for nearly 430,000 insurance claims a year in the UK for mobile phones being dropped in drinks.

Gadget-Cover asked a cross-section of customers how their phones ended up being drowned, and there’s been a slight change in reasons for water-, wine- and beer-logging.

“For men, the main cause remains stretching across a desk or table and their phone falling out of their shirt pocket into a drink, or a phone being knocked into a drink during a meeting – people wave their arms around in meetings, often with a phone in their hand, and some contrive to lose grip on their phones and get a bull’s-eye on a cup of tea or coffee they could never manage if they tried,” said Carmi Korine of www.gadget-cover.com.

“For women, the main cause is a child, toddler or baby playing with a phone that they drop into a cup or glass, but with an emerging trend for children to wash phones they’ve gooped, or to put them in washing machines.

“Those are the two single biggest causes at around 40% each (170,000 each, 340,000 total) – primarily because more people have more phones, and have them in their hands more of the time; but there is a fall-off in phone rage or phone envy when the owner of the phone is not directly responsible for it finding its way into a drink – down from around 45,000 to around 36,500.

“Arguments between couples have resulted in a doubling in the number of phones being dropped into drinks deliberately – up to 11,000 a year compared to 5,500 a year in 2009. Working on holiday, or simply working too hard are other issues – that’s also doubled to around 2,000 incidents of that nature.

“Office parties and drinking sessions with work colleagues can result in an ever-ringing phone being dropped in a pint, and we do get quite a few claims when a client or customer has dropped a supplier or adviser’s phone in a drink because they keep answering it during meetings – if we gross up our claims levels pro-rata nationally, then this would equate to around 2,000 claims.

“People ‘posing’ or showing off their phones, or talking embarrassingly loud in bars or restaurants resulted in around a thousand incidences of snatch-and-dunk.

“But at least once a day a stroppy pub landlord will take a phone off a customer and drop it in a drink – usually in the north, and usually because the pub has a phone ban.”

The remainder of claims arise from phones being left on table tops and being drowned in spreading pools of spilt drinks, phones left in bags with leaky drinks containers, or unexplained incidents in which phones are swamped.

The Easter break will be the first big test of wedding vows for thousands of couples in 2012 – and a measure of how many marriages are at breaking point.

There is tremendous tension amongst couples under financial pressure, and that means any sort of holiday or break could be anything but that for families battling the stress of downturn, job worries, paying council tax bills and facing fuel price issues – the vow of ‘for richer, for poorer’ will come under serious strain,” said Kim Aucott of the Manchester-based firm.

“Suddenly being crammed together at a potentially big-spending time when money is tight, and without work to distract, could result in frustrations being vented and some cards being laid on tables.

“These things can happen very suddenly – especially if there’s a cocktail of good Easter weather and a few drinks in the sun with emotions running high.

“But no matter how fast or bitter the split, it is rarely a good idea to start court proceedings immediately – a common knee-jerk when for many people this is uncharted territory.

“They may have made the decision to part, but the full potential for aggression should be allowed to subside before acting.

“Divorces are often started when couples are feeling angry, hurt, sometimes betrayed, and their first reaction is to think about going to court – but there are other options, not least collaborative law which means proceedings don’t go anywhere near a courtroom and can therefore stay both amicable and private,” said Kim.

“We’ve seen many people who, once they’ve reached the decision they want to divorce, go headlong into the legal process without actually weighing up what is going to be best long-term for their entire family.

“They need to get comprehensive advice of what the options are, and they need to get advice on the pros and cons of each of those routes – how much each is going to cost, how long they’re going to take to get to the end, is there any level of compulsion, and how much level of contention there’s going to be.

“Couples are often unaware that their disputes can be resolved through mediation, through collaborative law, and, as a fallback, there’s the court process.”

But Kim says a non-adversarial collaborative type approach could cost far less and avoid the bad feeling a courtroom encounter generates.

The number of pre- and post-nuptial agreements and cohabitation agreements has soared in the past year as well-heeled parents move to protect family wealth from outsiders.

Robin Charrot, a partner in the family law team at Manchester-based George Davies Solicitors LLP, says that a combination of families having to give more financial assistance to their children, the increasing divorce rate, and the sky high rate of failure for unmarried couples is making parents ever-more protective of family assets.

“In the case of divorce involving a son or daughter, sometimes even more than half of all assets can be claimed, and family money is not exempt. On top of that, there may well be claims for maintenance for life, and more and more parents are seeing this,” said Robin Charrot.

“The damage is not as catastrophic with the ending of a cohabiting relationship. However, ex-cohabitees could still have claims for up to half of most types of property, and, if there are children involved, the claims could be far more extensive than just child maintenance.

“If the split is amicable, then things can be settled relatively quickly and easily. However, this still means months of uncertainty and thousands of pounds in legal charges. However, if it gets combative and goes to court then there is the potential for a huge legal bill because these disputes can go on for years.

“Pre- or post-nuptial agreements and ‘cohabitation agreements’ are the solution. They were once considered to be toothless, but that has all changed now: If they are done properly, the courts are almost certain to accept them. In many cases they can completely exclude family wealth from claims, and in the cases where this is impossible, they can at least severely restrict claims.

“They provide certainty, help manage expectations, and ensure that parents who want to help their children but keep the wealth in the family are protected.

“Depending upon the detail of the agreement, the costs are almost always in the low four-figures, whereas taking a dispute to court can easily amass a six figure legal bill, and cost the family dear in terms of their assets that are lost forever.”

INSURER TO PUBLISH 250 MILLION MILE REPORT WHICH COULD CHANGE THE WAY CARS ARE INSURED.
A report on the analysis of more four billion fields of data collected from 250 million miles of vehicle journeys looks set to change the way car insurance premiums are set.

Insurance pioneer Johan van der Merwe, who acquired telematics-based pay-as-you-drive insurer Coverbox earlier in 2012, commissioned the report which has assessed the behaviour of tens of thousands of drivers since 2009.

It will be presented to a select panel of leading insurance companies in March.  Telematics records the movement of vehicles for analysis – including acceleration, braking, cornering as well as routes and parking location and other parameters - via GPS.

"What it reveals is that there's an overwhelming case for changing the way the insurance industry sets premiums: we can record, analyse and compare driving behaviour as against applying insurance 'proxy ratings' - we get factual driving information, and base rates on driving style and location rather than lifestyle and home address," said Mr Van der Merwe.

"Addresses are relevant to theft - massively less-likely with modern vehicle security - whereas driving style is relevant to injury or death, which obviously command much higher compensation payments.

"A low mileage car 'living' in a proxy rating high-risk area may rarely move, and may even be driven very carefully, but a high mileage car whose owner lives in a proxy rating low-risk area may actually be driven very aggressively through many rush-hour accident black spots, or in dangerous 'super-peak' periods.

"The report illustrates that both insurers and drivers will be better off if insurance is rated on driving style rather than lifestyle, and that good drivers don't suffer from the behaviour of bad drivers.

"The beauty is the speed with which the system could be introduced."

Coverbox pay-as-you-drive insurance allows drivers to take out comprehensive cover paid for by the mile, with the price per mile varying according to the time of the day or night: off-peak, peak or "super-peak" times.

FAKE INSURANCE CLAIMANTS CAUGHT WITH TROUSERS DOWN – LITERALLY.

A naked bedroom raider and a trouser-removing prostitute who couldn’t be fought off one-handed by a youth carrying a takeaway are amongst dodgy and declined insurance claims made for lost or stolen mobile phones.

More and more fraudsters are being caught with their pants down as insurers tighten the belt on ever more creative bids to trouser cash from false or questionable mobile phone loss and theft claims.

Gadget-cover.com, which provides policies for resellers including many high street names, saw a near-doubling of insurance claims for lost or stolen mobile phones in January 2012 over January 2011, but it would have been higher still had new tougher checks not identified fake or suspicious claims.

Carmi Korine of www.gadget-cover.com, which is the biggest and longest-established insurer in the sector, said that two attempted claimants in particular were caught, literally, with their pants well and truly down.

“One attempted claim arose when a customer’s son went on holiday with a friend and his friend’s parents. The phone was alleged to have disappeared one night when, whilst they were all in bed, a naked guy came in to the parents’ room and got in the bed with them.

“The father then awoke and kicked the naked guy out of their room, but before leaving, the naked guy put on the customer’s son’s trousers, which were on the floor, and left – we weren’t given a clear explanation as to why his trousers were in his friend’s parents’ hotel room.

“The phone was said to be in the trousers which were taken by the naked guy. The parents did not think the incursion was strange, and carried on with their sleep. There was no sign of forced entry.

“The second incident is also alleged to have involved a loss of trousers. The claimant’s son was coming home from a takeaway shop. He said he walked into a back street in order to wait for a cab, which he had called for earlier.

“Whilst waiting for the cab in this back street, a woman, who he described as looking like a prostitute, walked up to him and began touching him and pulling down his trousers. The customer says her son tried to push the ‘prostitute’ away but was ineffective in his efforts as he was carrying his takeaway in one hand.

“The woman managed to pull his trousers all the way down to his ankles and, after a while, she left and he later realised his phone was no longer in his pocket. The customer’s son was so traumatised he did not leave his room for three days.”

In each case, and based on wider assessment of the submissions made, but withheld here to avoid identification, the claims were declined.

Car insurance premium-setting-by-postcode should be ditched and replaced by a rating process based on a system of risk assessment developed for 17th century shipping.
That’s the view of insurance pioneer Johan van der Merwe who says that advanced but established 2012 telematics technology would produce far more representative insurance premiums based on where and how a car is driven rather than socio-economic factors relating to the owner’s home address.
Mr Van der Merwe and a group of fellow investors acquired UK pay-as-you-drive car insurer Coverbox earlier in 2012, and with it they acquired telematics technology which monitors the time, place and manner in which a car is driven, all of which he says are more significant in calculating insurance premiums than where the car owner’s home is.
“Theft of a vehicle from its owner’s home is a minor consideration for insurers when compared with the third party injury consequence of an accident. The cost of compensation for injury after even a relatively minor accident can be huge, and increases pro-rata with the number of occupants of vehicles involved,” said Johan van der Merwe.
“Currently premium and risk calculations are worked backwards from claims rather than forward from actual risk.  Claims are themselves flawed and as such not an accurate measurement of risk.
“But insurance premiums are rated on the home postcode of the car owner or user, and that car can often spend only a part of the day or night there, with a comparatively low theft risk.
“The remainder of the day it is driven through the rush hour, or on a school run, or on a shopping trip, and then parked in a location which may be more or less risky than the home location.
“But there is more danger of an accident in an urban rush hour than a motorway rush hour, more danger of accident if driving overnight or through an accident black spot and so on. So somebody who lives in a high-risk postcode but parks their car for most of the day in a low risk area is perhaps being charged too high a premium, while somebody who lives in a low-risk area and drives through accident black spots in the rush hour is being charged too low a premium.
“This is where 17th century insurance risk assessment comes in, when underwriters sat in dockside coffee houses and assessed the risk value of each and every ship leaving the port according to cargo, route, season, state of repair of the ship and level of experience of the captain.
“Telematics – on-board measurement, movement, location and systems monitoring and recording – track the vehicle, how and where it is being driven, and provide us with information which enables us to accurately assess the insurance risk of that specific car based on route and driving behaviour.
“The system will generate the technological version of a wince if the car is being driven through an accident black spot at peak time, but be far more relaxed if the route and time of travel is less risky. That will be reflected in an according premium adjustment, and, because the driver can go online and see what the system thinks about driving behaviour or location, may even cause him or her to alter their driving standards or routes they travel. That obviously has massive potential for bringing down, for instance, young drivers’ insurance costs by changing their behaviour.”
